Legal and Compliance Officer
The key responsibilities of a Legal and Compliance Officer revolve around ensuring that the organization adheres to legal standards and internal policies. They develop and implement comprehensive compliance programs, which include drafting and revising company policies to align with current laws and regulations. Regular monitoring of compliance is essential, as they conduct audits and compliance assessments, ensuring that a culture of compliance is fostered within the organization.The ideal candidate should be able to identify potential compliance risks and devise strategies to mitigate them, while preparing detailed reports for senior management and regulatory bodies on compliance status and issues. Acting as a liaison between the organization and regulatory agencies, he/she will facilitate effective communication regarding compliance matters and collaborate with various departments to enforce compliance standards throughout the organization.
Key Responsibilities:
- Develop and implement an effective legal compliance program, including policies and procedures (including AML/CFT/PF requirements), and controls that address all relevant regulatory requirements and risks
- Draft and review company policies and procedures (including AML/CFT/PF requirements) to ensure compliance with all national and international laws and regulations
- Support periodic review and enhancements of compliance policies, SOP and guidelines
- Perform periodic compliance monitoring and follow up on any potential violations of internal policies
- Provide advisory support to the business and management team on regulatory and compliance matters
- Implement regular and ad-hoc compliance training for internal stakeholders
- Work together with the company’s in-house counsel on local and foreign regulatory license applications
- Liaise with local and foreign regulators on regulatory issues and submission of periodic reports
- Manage regulatory compliance with licence conditions, applicable legislation, rules and regulations that govern the company
- Assist in audits by handling and responding to requests, queries and observations from regulators and auditors
- Draft and review various commercial contracts and agreements (i.e. service agreements, sale and purchase agreements, share sale agreements, investment agreements)
- Deal and liaise on corporate documents of legal entities with local and international company secretary
- Research laws and regulations related to the financial regulation, particularly Digital Asset Custodian to ensure the company’s operation, expansion and business products comply with all relevant laws and regulations
- Liaise with regulatory authority on matters relevant to our Digital Asset Custodian license
Qualifications & Requirements:
- Minimum of 5 years of working experience either as a practicing lawyer orin a compliance role within the financial industry, with a strong preference for candidates with experience in payment services and AML/CFT/PF
- Bachelor’s degree in Law
- Comprehensive knowledge of the regulatory environment in Malaysia
- Familiar with AML and KYC best practices in Malaysia, and ideally, within the APAC region
- Experienced in Capital Market Service license applications
- Excellent communication skills
- Adaptable to fluid and fast-paced working environment
- Independent learner with a “can do” attitude
- Excellent analytical skills with meticulous attention to detail to identify and correct compliance practices
- Experience or established relationships in any of the following industries would be a plus point: Banking, Cryptocurrency, Payment Services, Trading, Markets, or Exchanges.
- Professional compliance certification, particularly in AML/CFT/PF would be viewed favorably
